In case of Sonic 3 and Knuckles, the soundtrack was composed by a bigger number of people and they would need to pay every single one of them and I would assume SEGA don't want that, keeping in mind that they would need to pay royalties for both the team that worked on Sonic 3's soundtrack and the one that have worked on Sonic and Knuckles' soundtrack. SEGA doesn't actually own the rights for the music of Sonic games and they pay royalties in case the songs would ever be used, yes, even for Green Hill, they basically have to pay Nakamura everytime a song of his is used(the songs that were originally composed by him are also missing from Sonic Mania official soundtrack release). In case you don't know what's that about. It's safe to assume that SEGA have paid the royalties for the soundtrack back during the lawsuit in 2012, unless there is some sort of time limit but I doubt it. The game hasn't been taken down yet and it's been on Steam since 2011.
